These Terms of Service ("Terms") govern your use of Skyline Touch POS software and skylinepointofsale.com (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Skyline Touch POS provides point-of-sale software for retail stores and restaurants. The Service includes the Windows and Android POS application, optional cloud sync backend, owner portal, and related integrations.
Free trials last 14 days. No credit card is required to start a trial. At the end of the trial, you must subscribe or your access will end. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for partial months.
You may not use the Service to:
All software, documentation, and content on skylinepointofsale.com are owned by Skyline Touch POS and protected by copyright and trademark law. You receive a limited, non-exclusive, non-transferable license to use the software during your active subscription. No ownership is transferred.
Your business data (products, orders, customers) remains yours. You grant us a limited license to store and process it solely to provide the Service.
We target 99.9% uptime for the cloud backend. Scheduled maintenance is performed with advance notice when possible. The restaurant edition operates entirely on your local network and its availability is not dependent on our servers. We are not liable for downtime caused by your internet service provider, local network, or hardware.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYLINE TOUCH POS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRIOR TO THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You agree to indemnify and hold harmless Skyline Touch POS, its officers, and employees from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
We may terminate or suspend your access immediately if you violate these Terms, engage in fraudulent activity, or fail to pay fees after the grace period. Upon termination, your right to use the Service ends immediately. We will provide a data export on request within 30 days.
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Cook County, Illinois.
We may update these Terms occasionally. Material changes will be emailed to active subscribers with 30 days' notice. Continued use after changes constitute acceptance.
